Johnson v. McIntosh: Supreme Court ruling on discovery, acquisition, and rights of native peoples in the US, based on the idea of Christian European domination.
Johnson v. M’Intosh was a landmark 1823 Supreme Court case that, under Chief Justice John Marshall, established the doctrine of discovery, granting the United States (as the successor to European nations) the exclusive right to acquire Native American lands. This meant Native American tribes could only occupy lands, not sell or transfer them to individuals, and the federal government held the sole right to negotiate with them for their removal and sale. The case invalidated private purchases of land made directly from Native American tribes and has been a foundational, though controversial, case in federal Indian law.
