The “Right To Travel” is not ONLY about

the drivers license issue,

it is much bigger than you realize;

To best comprehend the basis for the “Right to Travel”

please read Shapiro v. Thompson 394 U.S. 618

This Court long ago recognized that the nature of our Federal Union and our constitutional concepts of personal liberty unite to require that all citizens be free to travel throughout the length and breadth of our land uninhibited by statutes, rules, or regulations which unreasonably burden or restrict this movement. That [p630] proposition was early stated by Chief Justice Taney in the Passenger Cases, 7 How. 283, 492 (1849):

“The constitutional right to travel from one State to another . . . has been firmly established and repeatedly recognized.” United States v. Guest, 383 U.S. 745“] 383 U.S. 745, 757.”

“This constitutional right, which, of course, includes the right of “entering and abiding in any State in the Union,” 383 U.S. 745, 757.”

“This constitutional right, which, of course, includes the right of “entering and abiding in any State in the Union,Truax v. Raich, 239 U.S. 33, 39, is not a mere conditional liberty subject to regulation and control under conventional [p643] due process or equal protection standards. [n1]”

[T]he right to travel freely from State to State finds constitutional protection that is quite independent of the Fourteenth Amendment.

  1. I’m not quite sure why you reference this case ( Shapiro v. Thompson 394 U.S. 618).
    Our right to travel from state to state is no longer a general concern and the case cited concerns primarily the freedom to migrate and receive state benefits without a waiting period.
    I believe that most of us, when we are concerned about the “right to travel,” are concerned about the of travel. In other words, what conveyance can we use to travel and what restrictions can be applied to that conveyance, or us, that would result in restricting our travel. There are plenty of cites that can be used to address that situation.
    On the other hand, why are we even concerned with “their” cases. They are not applicable to man and would only be used as a reference (cf) as comparable beliefs to our beliefs in law: common.
    Just my thoughts and 2 cents worth.

    • Thanks for the comment: i only posted this cite to show folks the broader aspects of the Right to Travel… i never meant to diminish or distract from the Right of Locomotion (http://www.cougarcorner.com/viewtopic.php?f=5&t=8282) or the right to use your property (car, truck etc…) as you so choose regardless of what label THEY place on your property, … and just for the record (and to avoid being tased), i have TAGS and insurance on my property, and I have a “drivers license” in my pocket; at this time, i simply have too many other interests to pursue.

  2. I don’t understand, if this site is to aid people to pursue law systems as people vs. Persons/corporations, with restrictions and privileges… why would you, the promoter maintain the very objects you are saying are not necessary, in claim that you have greater things to pursue?

    Would not pushing for this one thing be the foundation for living as life in truth, practicing not participating with things one does not understand?

    People peach what you ‘can’ do, yet do not do it themselves. Makes me doubt the validity and source of information.
